Mr. Douglass provides advice in both litigation and business consulting matters requiring specialized financial and economic expertise. He has more than fifteen years of experience in business valuation, analysis of damages in securities litigation, valuation of intellectual property in trademark and patent disputes, loss causation analysis, solvency analysis, regulatory compliance consulting, and general economic and financial analysis.

His business consulting experience includes new business venture valuation and market analysis, private equity due diligence, and business strategy. Mr. Douglass has testified on issues including damage and solvency analysis, loss causation, and business valuation.

Mr. Douglass is a Certified Public Accountant licensed in Texas and Florida, and is Certified in Financial Forensics (CFF) and Accredited in Business Valuation (ABV) by the American Institute of CPAs. In addition, he is a holder of the right to use the Chartered Financial Analyst (CFA) designation, a Financial Risk Manager (FRM) certified by the Global Association of Risk Professionals, and a Certified Fraud Examiner.

Financial Analysis, Valuation, and Solvency Analysis

  • Served as a testifying expert in the valuation of a large hospital chain located in the mid-western US.

  • Valued lost profits and served as the testifying expert in several cases in the timeshare industry.

  • Valued a major grocery store chain located in the southeastern US.

  • Led analysis in support of denial of Plaintiff’s class certification in a class action securities case involving the offshore seismic data industry (oilfield services).

  • Valued a natural gas pipeline network (and associated terminals) in the southeastern US.

  • Valued a company providing transaction management and associated services in the energy industry.

  • Performed a damage analysis related to the acquisition of a large petroleum liquids exploration and production company operating in the Bakken formation.

  • Analyzed the value of a major oil pipeline connecting Cushing, OK with Gulf Coast refineries.

  • Determined damages associated with the lost value of a business operating shallow-water jackup rigs in the Gulf of Mexico.

  • Determined damages associated with the loss of natural gas well opportunities in the Marcellus shale formation.

  • Led a team in the analysis and valuation of billions of dollars of FAS 125/140 off-balance sheet entities for one of the largest bankruptcies in history.

  • Led a project valuing the share price impact of company accounting in a multi-billion-dollar litigation case in the energy industry. 

  • On behalf of a court-appointed receiver, served as a testifying expert and calculated damages associated with a transfer of assets to a related party in the construction industry.

  • Assessed the value of a chain of convenience store franchises in the Dallas-Fort Worth area.

  • Led the valuation of a large store-in-store startup business using discounted cash flow, multiples-based and Monte Carlo analyses.

  • Performed a solvency analysis on a major prepaid telephone card manufacturer and seller.

  • Led a solvency analysis of a major paper manufacturer in the Southeastern United States.

  • Served as a testifying expert and calculated damages associated with a breach of contract dispute in the IT Services industry.

  • Analyzed the ability of a regional plastics manufacturer to qualify for and obtain a supersedeas bond.

  • Assessed lost tax revenue associated with a city’s loss of a major development (lost to a neighboring city).

  • Analyzed the solvency of a major property and casualty insurance provider in Ohio.

  • Determined the value of a minority shareholder interest in a Philippine hydroelectric power and water project.

  • Analyzed consequential damages to a regional water supply authority associated with repairs to a major water reservoir owned by the authority.

  • Served as a testifying expert and assessed damages in a breach of contract involving a real estate purchase option.

  • Served as a testifying expert and analyzed damages in a breach of contract matter involving the headmaster of a major private school.

  • Served as a testifying expert in the assessment of copyright infringement damages in the rug manufacturing industry.

  • Valued a hospital brand name in a trademark infringement matter.

  • Assessed the impact of a loss of branding rights to the value of a television series.

  • Determined the value of patents held by a startup that creates secondary power solutions in the long-haul trucking industry.

Acquisition Due Diligence

  • Assessed the strategic benefit of a multi-billion-dollar acquisition in the home technology marketplace.

  • Performed due diligence analysis for an acquirer in the home plumbing and fixtures market.

Antitrust Analysis

  • Assessed the degree of market control of a large aerospace engine manufacturer in the engine overhaul market.  Also, in related litigation, assessed the degree of control by the same aerospace company in the market for aftermarket parts.

  • Worked on assessing anti-trust claims in the waste management industry.

Business Strategy

  • Led multiple projects to define market size, calculate market share, and recommend key product growth areas for one of the largest home technology products businesses in the world.

  • Co-founded and developed an internal company at Bank of America that provides automated contact management services to financial institutions.  Sold the company in nine months, generating more than a 600 percent return.

Investigations & Compliance

  • Worked with a major bank to investigate alleged asset misappropriation.

  • Worked with a large mortgage servicer to develop enhancements to policies, procedures, and controls in preparation for a CFPB examination.
